Local man with 56,000 child sexual abuse files sent to prison

McALLEN, Texas – A 29-year-old Penitas resident has been ordered to federal prison for receiving and distributing child pornography. Jesus David Gutierrez pleaded guilty Oct. 2, 2025. U.S. District Judge Drew B. Tipton has now ordered Gutierrez to serve 110 months in federal prison and to pay $6,000 in restitution. At the hearing, the court heard additional evidence that Gutierrez was associated with approximately 56,000 files containing child pornography, was involved in the sale of pornography of adult women from the Rio Grande Valley, and was beginning to collect child sex abuse material (CSAM) for future sales. He must also serve five years of supervised release following completion of his prison term, during which time he will have to comply with numerous requirements designed to restrict his access to children and the internet. Gutierrez will also be ordered to register as a sex offender. The investigation revealed a computer associated with a specific IP address in Penitas engaging in downloading and distributing CSAM. On June 3, 2025, law enforcement executed a search warrant at his residence and found Gutierrez hiding in his bedroom closet. He admitted to having CSAM on his cellular phone. Forensic analysis resulted in the discovery of 63 videos and 141 images depicting prepubescent children engaged in sexually explicit conduct. Gutierrez has been and will remain in custody pending transfer to a Federal Bureau of Prisons facility to be determined in the near future. FBI McAllen conducted the investigation. Parcell prosecuted the case, which was brought as part of Project Safe Childhood, a nationwide initiative the Department of Justice launched in May 2006 to combat the growing epidemic of child sexual exploitation and abuse.
